O presente artigo se propõe a examinar criticamente o atual e dominante paradigma político, que aqui definiremos como terrorismo legal de Estado. Para tanto, fez-se necessário o recurso a três autores cujas reflexões buscam compreender a sua natureza e os seus principais modos de atuação, a saber, o filósofo italiano Giorgio Agambem, o jurista argentino Raúl Zaffaroni e o sociólogo francês Loic Wacquant. A partir das obras agambenianas Homo Sacer. O poder soberano e a vida nua I e Estado de (...) Exceção, elucidaremos o conceito de estado de exceção e o processo que, ao transformá-lo em prática permanente, marcou o ingresso definitivo do Estado na lógica do terrorismo. A materialização deste exercício de poder se dá – sobretudo nas conjunturas do continente americano, a referência empírica da pesquisa aqui apresentada – principalmente por meio da eliminação pelo encarceramento, levada a cabo por um direito penal punitivista que será compreendido à luz das obras O inimigo no direito penal (Zaffaroni) e Crime e castigo nos Estados Unidos: de Nixon a Clinton (Wacquant). This chapter argues that from a particularly weak recombination principle and plausible assumptions about the nature of parthood and location, it follows that it is possible that the mereological structure of the material world and that of space-time fail to correspond to one another in very radical ways. The chapter suggests, moreover, that rejecting the possibility of such failures of correspondence leaves us with a choice of no less unappealing alternatives. Within feminist literature from the early 1970s to this day, assisted reproductive technologies have been largely known to divide, replace or eliminate biological motherhood. For example, while in the past biological motherhood was considered a continuous experience, in vitro fertilisation (IVF) and IVF using egg donation allowed a split between two biological mothers, one providing eggs (genetic mother) and the other one gestation (gestational mother). This split was considered irreparable: the genetic mother could not be also gestational, and vice versa. (...) On the contrary, this paper aims to show that assisted reproductive technologies may also have a constructive potential towards biological motherhood(s). To explain how it could be possible, two existing techniques are explored: the first is maternal spindle transfer, which allows a double genetic motherhood; the second is reciprocal effortless IVF, which supposedly enables a double gestational motherhood. While in the first part, these techniques are examined singularly, in the second part a feasible combination of them is speculated. The idea is that assisted reproductive technologies could ‘recombine’ genetic and gestational motherhood in two figures that include both, namely in two ‘complete’ biological mothers, both genetic and gestational. This reading companion and commentary on Lacan Seminar XXIII provides detailed analyses of Lacan's seminar while maintaining an overall continuity and consistency. This book does not purport to provide an exhaustive and systematic line-by-line reading of a very complex and varied seminar. Rather it selects key themes of Lacanian theory that are found present throughout his work. In addition, the book does not try to simplify Lacan's ambiguous style, leaving the text open to different interpretations, while providing theory, commentary, and (...) lines of analysis into some of Lacan's important insights. Finally, this book is not about Joyce the writer, but more about the use that Lacan makes of Joyce. Its purpose is not to apply psychoanalysis to a literary subject, but rather to use the literary text to illustrate and develop psychoanalytic theory, and Lacanian theory in particular. It is an analysis of topology and language, or a linguisterie, as Lacan called it, for clinicians. The references to neurosis and psychosis are always there. It is widely held that all lies are assertions: the traditional definition of lying entails that, in order to lie, speakers have to assert something they believe to be false. It is also widely held that assertion contrasts with presupposition and, in particular, that one cannot assert something by presupposing it. Together, these views imply that speakers cannot lie with presuppositions—a view that Andreas Stokke has recently explicitly defended. The aim of this paper is to argue that speakers can lie (...) with presuppositions, and to discuss some of the implications this outcome has for current research on lying, assertion and presupposition. The distinction between lying and mere misleading is commonly tied to the distinction between saying and conversationally implicating. Many definitions of lying are based on the idea that liars say something they believe to be false, while misleaders put forward a believed-false conversational implicature. The aim of this paper is to motivate, spell out, and defend an alternative approach, on which lying and misleading differ in terms of commitment: liars, but not misleaders, commit themselves to something they believe to be (...) false. This approach entails that lying and misleading involve speech-acts of different force. While lying requires the committal speech-act of asserting, misleading involves the non-committal speech-act of suggesting. The approach leads to a broader definition of lying that can account for lies that are told while speaking non-literally or with the help of presuppositions, and it allows for a parallel definition of misleading, which so far is lacking in the debate. To understand the endogenous components of the event-related brain potential (ERP), we must use data about the components' antecedent conditions to form hypotheses about the information-processing function of the underlying brain activity. These hypotheses, in turn, generate testable predictions about the consequences of the component. We review the application of this approach to the analysis of the P300 component. The amplitude of the P300 is controlled multiplicatively by the subjective probability and the task relevance of the eliciting events, whereas its (...) latency depends on the duration of stimulus evaluation. These and other factors suggest that the P300 is a manifestation of activity occurring whenever one's model of the environment must be revised. Tests of three predictions based on this “context updating” model are reviewed. Verleger's critique is based on a misconstrual of the model as well as a partial and misleading reading of the relevant literature. (shrink)

The concept of adaptation is employed in many fields such as biology, psychology, cognitive sciences, robotics, social sciences, even literacy and art,1 and its meaning varies quite evidently according to the particular research context in which it is applied. We expect to find a particularly rich catalogue of meanings within evolutionary biology, where adaptation has held a particularly central role since Darwin’s The Origin of Species (1859) throughout important epistemological shifts and scientific findings that enriched and diversified the concept. Accordingly, (...) a conceptual taxonomy of adaptation in evolutionary biology may help to disambiguate it. Interdisciplinary researches focused on adaptation would benefit from such a result. In the present work we recognize and define seven different meanings of adaptation: (1) individual fitness; (2) adaptation of a population; (3) adaptation as the process of natural selection; (4) adaptive traits; (5) molecular adaptation; (6) adaptation as structural tinkering; (7) plasticity. For convenience here, we refer to them as W-, P-, NS-, T-, M-, S- and PL-ADAPTATION. We present the seven meanings in some detail, hinting at their respective origins and conceptual developments in the history of evolutionary thought (references are offered for further deepening). However, it is important to point out that evolution researchers seldom if ever refer to a single meaning purified from the others. This applies also to the authors we cite as representatives of one of the seven meanings. In Discussion and Conclusion draw from our work some future perspectives for adaptation within evolutionary biology. (shrink)

We study whether robots can satisfy the conditions of an agent fit to be held morally responsible, with a focus on autonomy and self-control. An analogy between robots and human groups enables us to modify arguments concerning collective responsibility for studying questions of robot responsibility. We employ Mele’s history-sensitive account of autonomy and responsibility to argue that even if robots were to have all the capacities required of moral agency, their history would deprive them from autonomy in a responsibility-undermining way. We will also study whether humans and technological artifacts like robots can form hybrid collective agents that could be morally responsible for their actions and give an argument against such a possibility. Many recent definitions of lying are based on the notion of what is said. This paper argues that says-based definitions of lying cannot account for lies involving non-literal speech, such as metaphor, hyperbole, loose use or irony. It proposes that lies should instead be defined in terms of assertion, where what is asserted need not coincide with what is said. And it points to possible implications this outcome might have for the ethics of lying.

We introduce the notion of τ-like partial order, where τ is one of the linear order types ω, ω*, ω + ω*, and ζ. For example, being ω-like means that every element has finitely many predecessors, while being ζ-like means that every interval is finite. We consider statements of the form “any τ-like partial order has a τ-like linear extension” and “any τ-like partial order is embeddable into τ” . I give shape to a neglected debate in metaphysics, the debate over the ontological priority between individuality and collectivity. I distinguish the debate from more familiar ones in the recent literature and articulate what I call ontological collectivism, the view that collectivity is prior to individuality. I defend the in-principle intelligibility of the view from forceful general objections and argue that not only is it coherent but also of significant interest to the literature: it allows for overlooked alternatives on a (...) variety of central discussions. In the past few years, machine learning (ML) tools have been implemented with success in the medical context. However, several practitioners have raised concerns about the lack of transparency—at the algorithmic level—of many of these tools; and solutions from the field of explainable AI (XAI) have been seen as a way to open the ‘black box’ and make the tools more trustworthy. Recently, Alex London has argued that in the medical context we do not need machine learning tools to be (...) interpretable at the algorithmic level to make them trustworthy, as long as they meet some strict empirical desiderata. In this paper, we analyse and develop London’s position. In particular, we make two claims. First, we claim that London’s solution to the problem of trust can potentially address another problem, which is how to evaluate the reliability of ML tools in medicine for regulatory purposes. Second, we claim that to deal with this problem, we need to develop London’s views by shifting the focus from the opacity of algorithmic details to the opacity of the way in which ML tools are trained and built. We claim that to regulate AI tools and evaluate their reliability, agencies need an explanation of how ML tools have been built, which requires documenting and justifying the technical choices that practitioners have made in designing such tools. This is because different algorithmic designs may lead to different outcomes, and to the realization of different purposes. However, given that technical choices underlying algorithmic design are shaped by value-laden considerations, opening the black box of the design process means also making transparent and motivating (technical and ethical) values and preferences behind such choices. Using tools from philosophy of technology and philosophy of science, we elaborate a framework showing how an explanation of the training processes of ML tools in medicine should look like. (shrink)

We analyze recent criticisms of the use of hyperreal probabilities as expressed by Pruss, Easwaran, Parker, and Williamson. We show that the alleged arbitrariness of hyperreal fields can be avoided by working in the Kanovei–Shelah model or in saturated models. We argue that some of the objections to hyperreal probabilities arise from hidden biases that favor Archimedean models. We discuss the advantage of the hyperreals over transferless fields with infinitesimals. In Paper II we analyze two underdetermination theorems by Pruss and (...) show that they hinge upon parasitic external hyperreal-valued measures, whereas internal hyperfinite measures are not underdetermined. In arguing against a supposed ambiguity, philosophers often rely on the zeugma test. In an application of the zeugma test, a supposedly ambiguous expression is placed in a sentence in which several of its supposed meanings are forced together. If the resulting sentence sounds zeugmatic, that is taken as evidence for ambiguity; if it does not sound zeugmatic, that is taken as evidence against ambiguity. The aim of this article is to show that arguments based on the second direction of (...) the test are misguided: ambiguous expressions, and in particular philosophically contested ones, do not reliably lead to zeugmaticity, so an absence of zeugmaticity provides no meaningful evidence for an absence of ambiguity. Pictures are notably absent from the current debate about how to define lying. Theorists in this debate tend to focus on linguistic means of communication and do not consider the possibility of lying with photographs, drawings and other kinds of pictures. The aim of this paper is to show that such a narrow focus is misguided: there is a strong case to be made for the possibility of lying with pictures and this possibility allows for insights concerning the question of (...) how lying should be defined. ABSTRACTA probability model is underdetermined when there is no rational reason to assign a particular infinitesimal value as the probability of single events. Pruss claims that hyperreal probabilities are underdetermined. The claim is based upon external hyperreal-valued measures. We show that internal hyperfinite measures are not underdetermined. The importance of internality stems from the fact that Robinson’s transfer principle only applies to internal entities. We also evaluate the claim that transferless ordered fields may have advantages over hyperreals in probabilistic modeling. (...) In the past few years, the ethical ramifications of AI technologies have been at the center of intense debates. Considerable attention has been devoted to understanding how a morally responsible practice of data science can be promoted and which values have to shape it. In this context, ethics and moral responsibility have been mainly conceptualized as compliance to widely shared principles. However, several scholars have highlighted the limitations of such a principled approach. Drawing from microethics and the virtue theory tradition, (...) in this paper, we formulate a different approach to ethics in data science which is based on a different conception of “being ethical” and, ultimately, of what it means to promote a morally responsible data science. First, we develop the idea that, rather than only compliance, ethical decision-making consists in using certain moral abilities, which are cultivated by practicing and exercising them in the data science process. An aspect of virtue development that we discuss here is moral attention, which is the ability of data scientists to identify the ethical relevance of their own technical decisions in data science activities. Next, by elaborating on the capability approach, we define a technical act as ethically relevant when it impacts one or more of the basic human capabilities of data subjects. Therefore, rather than “applying ethics”, data scientists should cultivate ethics as a form of reflection on how technical choices and ethical impacts shape one another. Finally, we show how this microethical framework concretely works, by dissecting the ethical dimension of the technical procedures involved in data understanding and preparation of electronic health records. Intentionalism is the view that demonstratives, gradable adjectives, quantifiers, modals and other context‐sensitive expressions are intention‐sensitive: their semantic value on a given use is fixed by speaker intentions. The first aim of this paper is to defend Intentionalism against three recent objections, according to which speakers at least sometimes do not have suitable intentions when using supposedly intention‐sensitive expressions. Various sources in the literature claim that the deduction theorem does not hold for normal modal or epistemic logic, whereas others present versions of the deduction theorem for several normal modal systems. It is shown here that the apparent problem arises from an objectionable notion of derivability from assumptions in an axiomatic system. When a traditional Hilbert-type system of axiomatic logic is generalized into a system for derivations from assumptions, the necessitation rule has to be modified in a way that (...) restricts its use to cases in which the premiss does not depend on assumptions. This restriction is entirely analogous to the restriction of the rule of universal generalization of first-order logic. A necessitation rule with this restriction permits a proof of the deduction theorem in its usual formulation. Other suggestions presented in the literature to deal with the problem are reviewed, and the present solution is argued to be preferable to the other alternatives. A contraction-and cut-free sequent calculus equivalent to the Hubert system for basic modal logic shows the standard failure argument untenable by proving the underivability of DA from A. (shrink)

Weder sind Vermutungen anfälliger für Unklarheit als andere Sprechakte noch sind sie besser dazu geeignet, Verantwortung abzuweisen.
